Terms & conditions of Conspect engineering – and limitations of service.

Limitations Applying to Our Professional Service & Terms and conditions of provision.


LIMITATIONS APPLICABLE TO PRE-ACQUISITION INSPECTIONS, DEFECT ANALYSIS, SNAG REPORTS AND CONSTRUCTION INSPECTION & REPORT SERVICES

COMPANY: – ‘The company’ or ‘company’ – here in refers to Conspect engineering & Michael Fleming and or operative professionals (representative surveyors, engineers & specialist testing or general contractors.

CLIENT:- ‘The client‘ or ‘client’ – here in refers to the person, persons, company, organization, management company or other customer that has engaged Conspect to provide a service from our portfolio of structural engineering, surveying & professional construction services.

BUILDER / DEVELOPER / MAIN CONTRACTOR:- ‘The builder’ or ‘developer’ – here in refers to the development companies and main contractors / builders that construct the properties (houses, apartments, commercial buildings, etc.).

These are 3rd party companies and builders that are independent to Conspect engineering and their sole purpose is to facilitate access for our staff and snag surveyors to a property that our ‘client’ has instructed Conspect to snag inspect & provide a report of issues and defects found. The snag list report is the only type of reporting that is copied to both ‘client’ / home owner & to the ‘builder / developer’. This is to enable repairs and rectification of issues found and listed to be worked upon.

Our ‘company’ Conspect engineering have historically and will continue into the future to remain independent & exempt our ‘company’ from offers of work from any and all of the main contractors and house builders – our independence is key to every snag list provided and should an instance arise were a main contractor or house builder has engaged Conspect or requires our professional services an obstacle and rule exists within our ‘codes of practice’ If hired by a ‘builder’ or offered work whether for commercial purposes in any capacity that involves remuneration, fiscal gain or payment of any type we are obligated to clarify to our ‘client’ that a conflict of interest exists and we would cease to act as their home snag list inspector or surveyor.

ESTATE AGENTS:- ‘The agent’ or ‘estate agent’ here in refers to the sales agent or property vendors representative. Conspect as a ‘company’ have limited interaction with estate agents with the exception of upon occasion facilitating snag list inspection appointments with builders and developers of housing / apartment developments.

Pre-purchase surveys ‘the agent’ will in the majority of instances be contacted directly by our office or surveyor to consent to agree to open up the property at an agreed time and date allowing our building survey to take place. Alternatively to comply with the sale contract term ‘subject to survey’ the agent will make contact with the property vendor (current owner / occupant) to arrange reasonable access for our ‘company’ surveyors, engineers & property inspectors.

  1. No time limit can be put on the survey process (within reason) during business hours i.e. – if our surveyor estimates the survey will take approximately 2 hours and the arranged time to meet on site to gain access is 2 pm, but instead the survey takes 3 hours (2 pm – 5 pm) this is outside the control of the surveyor and accommodation is reasonable to expect and can easily be facilitated by phone if the ‘agent’ wishes to gauge actual completion time.
  2. Were possible the estimated survey duration or snag list duration will be provided but unknown factors, housing in poor condition or limited by significant obstacles preventing reasonable access we cannot be held responsible and must report any obstruction to our ‘client’.
  3. This includes the home buyers being informed that an agent limited the time required to complete a satisfactory survey or snag list & that charges are applied to revisit and undertake the satisfactory completion of the property survey inspection.
  4. ‘Estate agents’ are 3rd party companies that are independent to Conspect engineering and their sole purpose is to be an intermediary between the property vendor or seller and the potential buyer ‘our client’. The sole job for an ‘agent’ is to facilitate access for our ‘company’ staff and snag surveyors to a property that our ‘client’ has instructed Conspect to survey or snag inspect & provide a report on same. Pre purchase survey reporting is not sent to the ‘agent’ and is only copied to our ‘client’, should details, defects & hidden issues and costs form part of the survey report we recommend contacting our office for advice on altering your offer and the costs associated with our findings. Relevant excerpts of the survey report should be collected in a summary and furnished to the ‘agent’ with your offer to be given to the vendor of the home or property (it is the agents obligation to inform a vendor of any and all offers and relevant information. The full content of your survey report should not be sent to various parties or allowed in the public domain, aside of GDPR rules and regulations the full content of report can be used against you or other buyers in a negotiation strategy .
  5. Similar to ‘builders & developers’ the rule exists within our ‘codes of practice’ If a relationship or prior dealings of any type exist between the Conspect ‘Company’ & an ‘estate agent’ we are obligated to clarify to our ‘client’ that a conflict of interest exists and we would cease to act as their home snag list inspector or surveyor.

Terms & conditions of Conspect engineering & -Limitations Applying to our professional service

  • Concealed Parts If we observe evidence to suggest that concealed parts of the structure and fabric might be defective, we will advise you accordingly and make recommendations for further investigations. However, unless otherwise instructed by you, we will not open-up for inspection any permanently enclosed or concealed parts of the structure and fabric.
  • Services Installations
    Our report on the services installations will be based on a cursory inspection only in order to include a general description. We will not test any of the installations. Unless otherwise instructed, we will not commission the inspection and testing of any installations by specialist consulting engineers. If we find visual evidence to suggest that there might be significant problems with any of the installations, or if they are particularly sophisticated or complex, we will advise you accordingly, and make recommendations for further investigations and/or testing by specialists.
  • Building Occupancy
    If we find that our inspection has been excessively limited, we will advise you accordingly and seek your further instructions. Our report will list any significant internal and external areas that we are unable to inspect.
  • Liability and Confidentiality
    Our pre purchase reports, surveys, defect reports and engineering reports may be relied upon by ‘our client’ only and to whom we owe a duty of care.
  • Report publication terms & conditions
    Our snagging, pre purchase or defect reports may only be relied upon by the named ‘client’ copy of document is confidential and can only be released to third parties upon receipt of the ‘client’s’ written consent.
    Publication of reports is reliant on a variety of factors including but not limited to materials and specialist testing results, third party sub contracted agents and the provision of their components of our report (CCTV surveys of drains, chimneys, drone surveys, GPS dimensional surveys etc.). It is our company policy when possible to provide reporting or at least interim reports four to five working days after a site visit or inspection. A set cap of ten working days is a limit to the supply of reports and in the case of general reporting and can be relied upon by Conspect with res judicata. If any time beyond this period is required to complete publication of reports clients will be informed in writing and options within your consumer rights will be provided.
Conspect engineering can be found by searching 'snag list company near me' and wherever 'near me' is we are and always will be independent of home builders accross Ireland and our sole purpose as snag surveyors is to perform a snagging inspection on a property that our 'client' has instructed Conspect to snag inspect & provide a report of issues and defects. Conspect's snag list report is the only type of reporting that is undertaken by a professional snagging company that is completely independent of the home builder, our staff are not paid by the home builders nor does our next job depend on a particular builder, our job is to ensure our client - the new home buyer is getting the best in finish, quality, safe, compliant with building regulations and your home is of the best standard possible.
